How to Read ISDA Netting Opinions
ISDA annually publishes updated netting opinions for over 50 jurisdictions. This symposium is designed to assist lawyers reviewing those opinions as they consider the critical questions posed to counsel each year. The types of counterparties, transactions documented under an ISDA Master Agreement, multibranch issues and what the presence or absence of specific netting or other legislation means will be discussed in detail. In addition, the Symposium will focus on the reasons why ISDA does not presently commission opinions in certain jurisdictions such as China and Russia and what must be present in a jurisdiction’s laws before such an opinion is undertaken, as well as outline what action ISDA takes to encourage authorities in non-covered jurisdictions to adopt model netting legislation.
