Succession Events

A series of refinancings and leveraged buy-outs has occurred over the past several months in which the surviving entity or entities may not represent a clear successor to any credit derivative transaction written on the original entity. Many of these events have occurred in Europe and latterly also in North America. ISDA has been consulting with members since the occurrence of the first of these events to address the question of how its Credit Derivatives Definitions can be amended in order to reflect the appropriate economic outcome of a transaction in such an event.
