The Markets in Financial Instruments legislation has been in effect since January 2018 and the European Commission will engage a review of the framework in 2020. In parallel, the EU institutions will implement the Review of the investment firms regime (Investment Firms review – IFR), which is directly linked to MiFID and potentially affects the way US firms can access EU markets. Several consultations are expected in the next few months and Brexit is also likely to bring further challenge and change as firms are confronted by both an EU MiFID and a UK MiFID.
