2018 Credit Support Deed For Initial Margin (IM) (Security Interest – English Law)

The 2018 Credit Support Deed For Initial Margin (IM) allows parties to establish initial margin arrangements that meet the requirements of margin regulations for uncleared swaps. ISDA previously published the 2016 Phase One IM Credit Support Deed to support Phase 1 of the initial margin requirements. The 2018 document has been adapted from the 2016 form for use by buy- and sell-side firms in view of the expansion of the impact of IM regulations to firms coming into scope in September 2019 (Phase 4), September 2020 (Phase 5) or later. Like the 2016 Phase One IM Credit Support Deed and the 1995 ISDA Credit Support Deed, this document is a stand-alone document (not an Annex to the Schedule) and creates an English law security interest over collateral.

An annotated version of the 2018 Credit Support Deed For Initial Margin (IM) is also included, setting out descriptions and explanations of the impact of each of the common elections that may be made in the document. The SEC IM Supplement (Third Party Segregation) supplement is designed for use where a party is subject to SEC regulatory initial margin (IM) requirements, and the parties wish to segregate their SEC IM with an independent custodian. It relies on the segregation terms contained in the existing ISDA initial margin documents, and can be used with any of the following: 2018 IM CSA, 2018 IM CSD, 2019 Bank Custodian CTA, 2019 Clearstream CTA, and 2019 Euroclear CTA.  You can access this supplement here.
