ISDA Regulatory Margin Self-Disclosure Letters

The ISDA Regulatory Margin Self-Disclosure Letter, published on June 30, 2016, is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in one or more of the following jurisdictions: (i) Canada, (ii) the European Union, (iii) Japan, (iv) Switzerland, and (v) the United States.

Note: For purposes of determining applicability of U.S. regulatory margin requirements for uncleared swaps to trading relationships, this letter has been superseded by the ISDA U.S. Self-Disclosure Letter (published on January 15, 2021).

The ISDA Regulatory Margin Self-Disclosure Letter– Australian Supplement published on December 23, 2016 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in Australia.

The ISDA Regulatory Margin Self-Disclosure Letter – Brazil Supplement published on February 10, 2020 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in Brazil.

The ISDA Regulatory Margin Self-Disclosure Letter – Hong Kong Supplement published on March 8, 2021 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in Hong Kong. It supersedes the version published on December 23, 2016.

The ISDA Regulatory Margin Self-Disclosure Letter – India Supplement published on September 19, 2022 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in India.

The ISDA Regulatory Margin Self-Disclosure Letter – Korea Supplement published on June 1, 2021 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in Korea. It supersedes the version published on June 12, 2017.

The ISDA Regulatory Margin Self-Disclosure Letter – Singapore Supplement published on December 23, 2016 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in Singapore.

The ISDA Regulatory Margin Self-Disclosure Letter – South Africa Supplement published on November 30, 2021 is intended to assist market participants with the exchange of the information necessary to determine if, and when, their trading relationship will become subject to regulatory margin requirements for uncleared swaps in South Africa. The ISDA Regulatory Margin Self-Disclosure Letter – South Africa Supplement published on September 27, 2023 reflects the updated implementation phase-in schedule as amended by “Financial Sector Regulation Act, 2017 Joint Standard Amendment 1 of 2023 Amendments to Joint Standard 2 of 2020 – Margin Requirements for Non-Centrally Cleared Over-The-Counter Derivative Transactions.”
